Constitutional limitations on the free movements of the country

IAS Mains General Studies Sample Answers

Topic: What are the constitutional limitations on the free movements in country?

The freedom of movement is provided as a fundamental right under Article 19(1) of the constitution to the citizens of India only. The right to freedom of movement is not absolute right but Article 19(2)-(6) provides that this freedom can be restricted on the grounds of the interest of the general public and for the protection of any schedule Tribe.

So, all the constitutional authorities, such as the Union and the states and other local statutory authorities may impose restrictions upon such freedoms, provided such restrictions are reasonable and are relatable to any of the grounds of public interests as specified in the Article.

On any other ground, any restriction, if imposed, on free movements of Indians throughout the country will be void.
